About the Role
We seek a proactive and detail-oriented Compliance Officer to oversee our regulatory obligations under the ASIC and AUSTRAC frameworks. The successful candidate will ensure our cryptocurrency trading operations comply with the Corporations Act 2001, Australian Securities and Investments Commission Act 2001 (ASIC Act), Anti-Money Laundering and Counter-Terrorism Financing Act 2006 (AML/CTF Act), and related regulations. This role is critical to maintaining our reputation, mitigating risks, and fostering a culture of compliance in a fast-paced, high-risk industry.
Key Responsibilities
ASIC Compliance
- Ensure compliance with AFSL conditions, including Design and Distribution Obligations (DDO), ensuring our cryptocurrency products have appropriate Target Market Determinations (TMDs).
- Oversee timely lodgment of ASIC-required documents, including annual company statements, financial reports (e.g., Form FS70), and notifications of changes to officeholders or registered office within 28 days.
- Manage breach reporting, notifying ASIC of significant breaches or likely breaches of financial services obligations within required timeframes.
- Maintain accurate corporate records and ensure the company name and Australian Company Number (ACN) or Australian Business Number (ABN) are displayed on all required documents and premises.
- Act as a point of contact for ASIC inquiries, surveillances, or investigations, ensuring timely and accurate responses.
AUSTRAC Compliance
- Develop, implement, and maintain a robust AML/CTF program (Part A and Part B) tailored to the money laundering and terrorism financing (ML/TF) risks of cryptocurrency trading.
- Oversee customer due diligence (CDD) and enhanced due diligence (EDD) processes, including identification and verification of customers and ultimate beneficial owners (UBOs), with a focus on high-risk clients (e.g., politically exposed persons or PEPs).
- Monitor transactions to detect suspicious activities, ensuring timely submission of suspicious matter reports (SMRs), threshold transaction reports (TTRs) for transactions of $10,000 or more, and international funds transfer instructions (IFTIs) to AUSTRAC.
- Prepare and submit the annual AML/CTF compliance report to AUSTRAC by March 31, covering the previous calendar year’s activities.
- Coordinate independent reviews of the AML/CTF program to assess its effectiveness and address deficiencies.
General Compliance
- Develop and maintain policies, procedures, and systems to support compliance with ASIC and AUSTRAC regulations, including record-keeping and internal audit processes.
- Provide regular training to employees on AML/CTF, financial services, and corporate governance obligations to foster a compliance-focused culture.
- Report compliance status, risks, and remediation plans to the board and senior management.
- Stay updated on regulatory changes in the cryptocurrency and financial services sectors, ensuring the company adapts to new requirements (e.g., updates to ASIC’s Regulatory Guides or AUSTRAC’s AML/CTF Rules).
- Collaborate with external advisors (e.g., compliance consultants, legal teams) to ensure robust regulatory adherence.

Qualifications/Skills Required
Essential:
- Bachelor’s degree in Law, Finance, Business, or a related field.
- 3+ years of experience in compliance, preferably in financial services, cryptocurrency, or a related regulated industry.
- Strong understanding of the Corporations Act 2001, ASIC Act, AML/CTF Act, and their application to cryptocurrency trading.
- Proven ability to develop and implement compliance programs, including AML/CTF frameworks and AFSL obligations.
- Excellent communication and stakeholder management skills to engage with regulators, senior management, and employees.
- Analytical mindset with strong attention to detail and the ability to identify and mitigate risks.
Desirable:
- Professional certifications such as Certified Anti-Money Laundering Specialist (CAMS) or Governance Institute of Australia’s Governance and Risk Management Certificate.
- Experience with ASIC and AUSTRAC reporting systems (e.g., ASIC Connect, AUSTRAC Online).
- Familiarity with cryptocurrency-specific risks, such as wallet security, market manipulation, or regulatory changes in digital assets.
- Knowledge of international AML/CTF standards (e.g., FATF recommendations) as they apply to cryptocurrency businesses.
